Helena judge halts Broadwater County tire dumping

HELENA – A judge has granted an injunction stopping the future disposal of waste tires at a Broadwater County property until the Department of Environmental Quality (DEQ) issues a permit.

According to court documents, Two Brothers Tire of Belgrade applied for a DEQ permit to collect and store used tires at a property on Muffley Lane in January 2018.

They paid the filing fees, triggering the review, but were never issued a permit.

DEQ says it began receiving complaints from residents in June alleging that Two Brothers had begun storing tires on the property, without a permit.

DEQ and the Broadwater County Board of Health sent letters telling the company that the must immediately stop hauling waste tires to the property, and remove them from the property.

Documents say that complaints about dumping continued after July 2nd.

Judge Kathy Seeley found Two Brothers failed to obey the orders of the DEQ and the Board of Health, and that the injunction is necessary to prevent the company from continuing to move tires to the property.
